The Containers shall be stowed at the Merchant’s premises.
The Merchant’s description of the Goods stuffed in a sealed Container,shall not be binding /conclusive on the Carrier.
The carrier in his absolute discretion to store the goods afloat or ashore .
The proceeds of sale cover the amount due.
The Carrier shall have a lien on the goods relating thereto for Freight,dead freight,demurrage and detention.
The value of the goods shall be declared by the merchant before shipment and inserted in this Bill of Lading
For the purpose of this clause,the declared value shall be the basis for calculating the Carrier’s liability.
The Carrier’s lien shall survive discharge or delivery of the goods.
The owners are not responsible for loss,damage or delay arising from the Carrier’s want of due diligence
Freight for the vessel’s ordinary disbursements at the port of loading shall be prepaid by the charterers.
The carrier are obliged to be responsible for the damage affecting the vessel’s seaworthiness and class.
Bareboat charterers, disponent owners and other operators are charged with the magt of vessel 除非承租人在24小时内书面形式通知船方，否则船方有权选择取消合同。
Unless the charterers have given such declaration in writing within 24 hours,the owners shall have the option of cancelling this Charter Party.
Subject to this section, an appeal shall be brought in such manner and shall be subject to such conditions as are prescribed by rules made under subsection.
The party A shall nevertheless have the right to cancel in part or in whole of the contract with prejudice to the party A’s right to claim compensations.
The authorities shall,within three months of the receipt of all the documents stipulated in Article 5 of the regulations, decide whether to approve or not to approve such documents.
The carrier shall be proved: any event or circumstance did not cause the loss, damage or delay in delivery or the carrier has to comply with the provisions or article 14 of due dilligence.
If the carrier is relieve of part of its liability pursuant to this article,the carrier is liable only for that part of the loss,damage or delay.
If a negotiable transport document has been issued and carrier and the holder agree to replace the document by a negotiable electronic transport record,the holder shall surrender the negotiable transport document to the carrier.
The period of responsibility of the carrier for the goods under this Convention begins when the carrier or a performing party receives the goods for carriage and ends when the goods are delivered.
Notwithstanding articles 11,the carrier or a performing party may decline to receive or to load, and may take other measures as are reasonable,including loading,destroying or rendering goods harmless
A maritime performing party is subject to the obligations and liabilities imposed on the carrier under this Convention, and is entitled to the carrier’s defenses and limits of liabilities as provided in this Convention.
If the carrier’s and performing party are liable for the loss of ,damage to or delay in delivery of the goods,their liability is joint and several but only up to the limits provided for under this Cnvtin
The carrier shall have the right in any way to any or all parts of freight, loading , discharge, storage, warehouse and handling services, as well as the carrier for all cargos related responsibility subcontracted to subcontractor.
The carrier such as intergrated delivery of this bill of landing, the carrier shall be responsible for the performance and /or reached from the place of receipt or port of loading to the port of dsicharge or delivery(whatever is applicable)transport.
All Freight shall be deemed fully,finally and unconditionally earned on receipt of the goods by the carrier and should be paid and non-returnable in any event whatsoever.
Whether before or after the receipt of the goods by the carrier , or delivery of goods to the Merchant before or after, the terms of this bill of landing shall apply to the carrier for providing container for all the responsibility of goods caused by.
The shipper shall inspect containers before stuffing them and the usage of a container shall be prima facie evidence of its being suitable without defect.
